Peter Fleckstein (aka Fleckman) has been reading the House Health Care bill and has been posting his findings on Twitter. On July 28th, I posted his findings through page 498, Today I will cover pages 502 through 757. His postings of the rest of the bill will follow. Note: All comments are Fleckstein's.
Let me say that all the discussion about health care has been about what the bill should or should not contain. But the discussion should be whether or not the bill is Constitutional.
Article 1, Section 8, lists the powers of Congress. If a power is not listed, the Congress has no authority to exercise such power. Health care is NOT listed. Therefore, Congress has no authority to even discuss such power.
OK, now lets look at Fleckstein's findings in this bill that will move the United States from being a free nation into a socialist totalitarian nation.
* PG 502 Line 5-18 Government builds the "Center" to conduct, support, & synthesize research to define our Health Care Services.
* PG 502 Section 1181 Center for Comparative Effectiveness Research Established. - Hello Big Brother - Literally.
* PG 503 Line 13-19 Government will build registries and data networks from YOUR electronic medical records.
* PG 503 Line 21-25 Government may secure data directly from any department or agency of the US including your data.
* PG 504 Line 6-10 The "Center" will collect data both published & unpublished (that means public & your private info)
* PG 506 Line 19-21 The Center will recommend policies that would allow for public access of data
* PG 518 Line 21-25 The Commission will have input from HealthCare consumer reps - Can you say unions & ACORN?
* PG 524 18-22 Comparative Effectiveness Research Trust Fund set up. More taxes for ALL.
* PGs 525-620 deals with the Govt basically taking over nursing homes, long-term care facilities (think assisted living) through regulations of the facilities, the owners and employees of SD facilities. and even the land owners of that SD facilities reside on.
Additionally as you read these 90+ pages you can come to the conclusion that any Health related svcs will be determined and rationed by the Govt for our senior citizens and others in nursing homes. This one post should do enough to raise awareness of the control the Govt is exerting over the older population of American citizens.
*PG 620 Line 1-9 The Government will define, prioritize, and nationalize your Health Care Services.
* PG 621 Lines 20-25 Government will define what Quality means in HealthCare. Since when does Government know about quality?
* PG 622 Lines 2-9 To pay for the quality Standards Government will transfer $$ from to other Government Trust Funds. More Taxes.
* PG 624 "Quality" measures shall be designed to assess outcomes & functional status of patients.
* PG 628 Section 1443 Government will give "Multi-Stake Holders" Pre-Rule Making input into Selection of "Quality" Measures.
* PG 630 9-24/631 1-9 Those Multi-stake holder groups including Unions & groups like ACORN deciding HealthCare quality.
* PG 632 Lines 14-25 The Government may implement any "Quality measure" of Health Care Services as they see fit.
* PG 633 14-25/ 634 1-9 The Secretary may issue non-endorsed "Quality Measures" for Physician Services & Dialysis Services.
* PG 635 - 653 Physicians Payments Sunshine Provision - Government wants to shine sunlight on Docs but not Government.
*PG 654-659 Public Reporting on Health Care-Associated Infections - Looks okay.
*PG 660-671 Doctors in Residency - Government will tell you where your residency will be, thus where you'll live.
*PG 676-686 Government will regulate hospitals in EVERY aspect of residency programs, including teaching hospitals.
*PG 686-700 Increased Funding to Fight Waste, Fraud, and Abuse.. You mean the Government with an $18 mil website?
*PGs 701-704 Section 1619 If your part of HealthCare plan that isn't in Government HealthCare Exchange but you qualify for Federal aid, no payment.
* PG 705-709 SEC.. 1128 If Secretary gets complaints (ACORN) on HealthCare provider or supplier, Government can do background check.
* PG 711 Lines 8-14 The Secretary has broad powers to deny Health Care providers/suppliers admittance into HealthCare Exchange.
*Pg 719-720 Section 1637 ANY Doctor who orders durable medical equipment or home medical services MUST be enrolled in Medicare.
*PG 722 Section 1639 Government Mandates Doctors must have face-to-face with patient to certify patient for Home Health Services.
* PG 724 23-25 PG 725 1-5 The same Government certifications will apply to medicaid & CHIP Your Kids
* Pg 735 lines 16-25 For law enforcement purposes, the Secretary of Health & Human Services will give Attorney General access to ALL data.
* PG 724 Lines 16-22 Government reserves right to apply face-to-face certification for patient to ANY other HealthCare service.
*PG 740-757 Government sets guidelines for subsidizing the uninsured (That's your tax dollars)
Please contact your two US Senators and Your US Representative. Tell them that health care is NOT one of the enumerated powers granted to Congress by our Constitution. Therefore, they should do everything in their power to stop any federal government takeover or any federal control of our health care.

Obamacare
Obama and his allies in Congress are masters of confusion and deception. They claim there are 47 million uninsured Americans. However, a 2007 U.S. Census Bureau Report says that of the 46 million "uninsured," more than 10 million were not U.S. citizens. On Friday Aug.14th, Ms Gluck, of the Kendall County (TX) Democratic Party, wrote a commentary in the Boerne (TX) Star newspaper entitled “We must not stand idly by.” She said that every American should support Obamacare, especially Christians and Jews because they commanded by God to help those less fortunate.

Re: Claire Oxley Gluck's “We must not stand idly by” (The Star 8-14)
While it is true that Christians and Jews are commanded to help those who are less fortunate, help is to be given with love and the free will of the giver – not by government decree and confiscation.
Is a federal government health care system or health care insurance constitutional? Article I, Section 8, specifically enumerates the powers granted to Congress and health care is not listed there, along with many other laws, both pending and passed, that restrict our liberty and our rights.
Our US Constitution was written to restrict the federal government. If a particular action is not enumerated, it is unconstitutional for the federal government to take such action.
Many say health care falls under the “general welfare of the United States” as listed in Article I, Section 8-1. However this phrase refers only to the powers granted to the federal government in Section 8.
Others refer to the "Necessary and Proper Clause" of Article I, Section 8-18. This does not grant the federal government unlimited authority, but gives it some leeway for certain things – only as long as those actions apply directly to the Constitution's specifically enumerated powers.
James Madison, considered the Father of our Constitution, stated "For what purpose could the enumeration of particular powers be inserted, if these and all others were meant to be included in the general power?”
The United States is a Constitutional Republic. Its government must follow the Rule of Law of its Constitution. Politicians and Judges are saying that our Constitution is a living document, meaning that it changes with the whims of society.
However, our Constitution must be followed as written and intended. When its meaning is questioned, the writings and speeches of our Founders must be researched, rather than looking to foreign law or a judge's personal opinion.
Our Founding Fathers were wise and knew that some things must change over time, that's why they wrote in the amendment process. They made the process hard and long so that our Constitution would not be amended frivolously.

Rights in Peril
Have you heard of H.R. 45? There is very real threat that this gun control bill poses a very real threatto your liberties. H.R. 45 would establish a national gun registry database which would increase requirements for firearms purchases, far beyond those ever proposed, create a national firearms registry overseen by the Federal Government and force you to take a written exam to prove that you are "fit" to exercise your Constitutionally protected right to keep and bear arms.
I would also recommend sending a personal note to your US Senators and your US Representative.
The controversial OSHA nominee and left-leaning public health advocate, David Michaels, also seems to have strong views on firearms issues. That's by no means irrelevant to the agenda of an agency like OSHA, because once you start viewing private gun ownership as a public health menace, it begins to seem logical to use the powers of government to urge or even require employers to forbid workers from possessing guns on company premises.
Then contact your two US Senators and request them to reject David Michaels as administrator of the Occupational Safety and Health Administration.
ACORN -- the Association of Community Organizations for Reform -- a publicly funded national organization is using your tax dollars to actively interfere with our Second Amendment. This group has intervened to defend anti-gun ordinances that have already been declared illegal by the courts. Since 1998, ACORN has received an estimated $31 million in government funding.
Contact your US Representative and tell him, or her, that it is time to stop funding radical organizations such as ACORN. By the way, ask where in our Constitution is funding of any organization authorized.
Alinsky’s Obama -- Saul Alinsky, the Father of community organizing, taught that those radicals committed to overthrowing the status quo society must look like they grow up out of the people. This willingness to disguise one's true nature in order to advance a radical agenda means that Alinsky students like Obama and Hillary Clinton (and much of the Democratic Party for that matter) can never be trusted in terms of what they say. The 2009 Aluminum Racing Products (ARP) Late Model Most Popular Driver Contest is on again. ARP will present a new race car body to the driver that receives the most votes.
The contest is open to the top ten Late Model drivers from the various Late Model Racing Series across the United States and my 15 year-old grandson, Dillon Spreen, is in fifth place in the Texas Super Racing Series.

Here is a recap of Dillon's racing career:
Fifteen year-old Dillon Spreen started racing Quarter Midgets at the age of 5 and by the time he was 11, he had won over a hundred races, seven championships and set several track records.
In mid 2005, he moved up to the Allison Legacy cars. In 2005 Dillon won the “Most Improved Driver” award and won the final race of the season. Dillon did not win any races in 2006, but his consistent 2nd and 3rd place finishes earned him enough points to win the Lone Star Allison Legacy Championship.
Dillon also won the Lone Star Allison Legacy Championship in 2007. He ran a total of 25 races in 2007, with 23 top 5 finishes, including 11 wins, 8 second places, 2 third places and 2 fourth places, with only 2 races out of the top ten. He also set 5 new track records during the 2007 season.
For 2008, Dillon moved up to the full size V8 powered NASCAR type Late Model cars in the very competitive Texas Super Racing Series (TSRS). Dillon finished 7th overall and 2nd in rookie points, competing against 37 of the top stock car drivers in Texas.
Dillon had held 6th overall and was the rookie points leader until two unfortunate incidents late in the season. Dillon was taken out by a wreck on Aug. 30th and then a rear suspension bracket failure took him out of the Sept.20th race.
Also Dillon, the youngest driver in the series, and his team received The Texas Super Racing Series (TSRS) Sportsman of the Year Award for outstanding sportsmanship toward the other drivers and teams during the 2008 season.
For the 2009 season, Dillon is driving the Alexander Racing Team's Late Model in the TSRS series. He is currently fifth in points and has one win.

Advice from Granny Warrior, Linda Hunneycutt
Folks, if I never do or say anything that gets your attention, please let it be to get prepared. If nothing happens, like in Y2K, then you are so far ahead and have saved tons of money as the cost of food keeps on going up and up.
By storing it now, you can save lots of money and assure your family will be well fed no matter what happens or doesn't. Make sure to get other items now also, like necessary supplies of toilet paper, feminine products, medications, soap, needles and thread, everything you use daily and don't even think about.
We are entering a time of real trouble which no one knows for sure what the outcome will be. Don't be caught unaware. Don't be caught at the grocery store and have nothing to buy or the money to buy it with.
Take your money out of the banks just for safety's sake since so many people are talking about bank closings. That could be disastrous for people to have money and not be able to use it
This may never happen and I hope it doesn't, but it could as it did back in the 30's. You all don't remember those days, but I do and it was not nice. Families were in real need.

What are we doing in the Middle East?
President Bush originally sent troops to Afghanistan to root out the Al Qaeda terrorists that attacked the World Trade Center. When the Al Qaeda hid out in the mountain caves and could not be found, Bush turned his wrath on Saddam Hussein in Iraq.
Obama said he would get our troops out of Iraq, and he is doing so. But, he is sending the troops to Afghanistan to fight the religious Taliban insurgents.
Since the time of Alexander the Great (born 356 BC), nation after nation has tried to stop the religious wars in Afghanistan, but failed.

Admiral Michael Mullen, Chairman of the Joint Chiefs of Staff, admits that things are not going well in Afghanistan. Despite the recent increase in troop strength, military commanders say that they need more troops. And any meaningful reinforcement will have to come from the U.S., not NATO, since most European countries are more interested in leaving than escalating.
Since WWII, we have troops stationed in Japan, Germany and just about every country in the world. Why? Is it time to bring our troops home? Let your US Legislators know your thoughts.

Although the AARP says it is not "officially" endorsing President Obama's healthcare reform, it is conducting a huge and costly television ad campaign in support of ObamaCare and hosted the president at an online forum recently to promote his agenda to AARP members.
The Left Leaning NY Times reported: "[HealthCare] Bills now in Congress would squeeze savings out of Medicare, a lifeline for the elderly, on the assumption that doctors and hospitals can be more efficient."
Be sure your US Senators and US Representative know you are opposed to any federal government involvement in your health care or insurance. Remind them that there is no Constitutional authority for them or the President to be involved in health care.

Let's Look At Our Pledge of Allegiance Adapted from the writings of David Barton
The Pledge of Allegiance is not actually part of our national heritage. It was written in 1891 by Frances Bellamy, a socialist clergyman. Bellamy was appointed to direct a national celebration of the public schools for Columbus Day on behalf of the National Education Association (NEA). In 1891 the public schools were still dominated by local school boards, but the NEA hoped to centralize education under the control of professional educators.
Frances Bellamy was a co-founder of the Society of Christian Socialists and the spokesman for the Nationalist Movement which promoted a socialist America. He was a follower of the Fabian Socialist movement which sought the same objectives as the militant Marxists, but employed incrementalism rather than violent rebellion. Bellamy’s plan was to incrementally introduce socialism through the school system.
The Pledge was originally written “my flag and the republic for which it stands.” No particular flag was mentioned as Bellamy wanted it to be an international pledge. The public schools, under pressure of the NEA, adopted the Pledge.
Soon the Pledge was under attack by patriotic organizations such as the Daughters of the American Revolution and the American Legion for the internationalism they saw it contained. They successfully lobbied Congress to alter “my flag” to “the Flag of the United States,” much to the dislike of Bellamy.
In 1954, when Congress added the phrase “under God” to the Pledge of Allegiance, President Eisenhower stated: “In this way we are reaffirming the transcendence of religious faith in America’s heritage and future; in this way we shall constantly strengthen those spiritual weapons which forever will be our country’s most powerful resource in peace and war.” The text of the bill asserted, “This is not an act establishing a religion...The phrase ‘under God’ recognizes only the guidance of God in our national affairs.”
The constitutional authority to utter the words “under God” in our pledge is right there in our founding documents. Our Declaration of Independence states the fact our Founding Fathers recognized the existence of God, and referred to Him as “Nature’s God” and “The Creator.” The Declaration makes clear what most citizens of the colonies believed; that they were establishing a new nation based soundly on the laws of God and even asked for God’s protection of our nation.
The secularists and others may argue that the Declaration of Independence has nothing to do with the Constitution. However the Declaration of Independence is the charter of the United States. This is the document that makes us a nation. It tells us who we are and what we stand for. It does not tell us how to run the country, that is what the Constitution is for.
In a corporation, the charter is higher than the by-laws and the by-laws must be interpreted to be in agreement with the charter. Therefore, our Constitution (our by-laws) must be in agreement with our Declaration of Independence. The most important statement in our Declaration is that we are to operate under the laws of God.
When the courts are deciding what our Constitution means, they must remember our national charter, the Declaration of Independence. The Constitution does not mention God, but it does not have to because the Declaration is a higher document. All our laws must be consistent with the laws of God or they will violate our national charter.
The Pledge of Allegiance, with the change to “the Flag of the United States” and with the words “under God” added, expresses the opposite of what its socialistic, one world government author intended. Congress not only acknowledged that we are a free and sovereign nation, but also that there is a God and that our nation is to operate under His laws.
Red Skelton aired this review of our Pledge on his TV show in 1969. The review was made by one of his school teachers and took place before “Under God” was added, as Mr. Skelton explains in his closing remarks.

The swine flu vaccine may do more harm than good.

The healthcare socialization battle in the White House war against Americans has taken a new turn--scare tactics to cause Americans to accept government control of their lives.
In the past two days, numerous stories have been written about how the government is preparing for a swine flu pandemic. First, there was a story quoting Health and Human Services spokesman Bill Hall that there are only 45 million doses of the swine flu vaccine that will be ready by mid-October--about a third of the anticipated need of 120 million. Then a White House panel of scientific advisors issues a warning that swine flu may hospitalize 1.8 million and kill double the people of a normal flu season, about 90,000.
When the swine flu outbreak occurred in Mexico in April, the White House declared a national health emergency. But Department of Homeland Security Secretary Janet Napolitano refused to issue travel advisories or to screen passengers on flights arriving from Mexico.
Dr. Richard Besser, head of the Center for Disease Control, said at the time, "We do think this will continue to spread but we are taking aggressive actions to minimize the impact on people's health."
Instead of shutting down travel and border crossings, the Feds released 12 million vaccine doses. Now, as children are returning to school, the White House has issued a report that the swine flu "poses a serious health threat to the nation."
NaturalNews.com editor Mike Adams reported on August 5 that the patent protecting the swine flu vaccine states that "ingredients used in the vaccine are derived from the kidneys of African Green Monkeys who are first infected with the virus, then allowed to fester the disease, and then are killed so that their diseased organs can be used to make vaccine ingredients."
Adams also documented that the patent is held by the National Institutes of Health and a large military defense contractor, DynCorp. DynCorp, Adams says, is contracted by the US government to patrol the US/Mexico border, near where the first H1N1 swine flu virus was originally detected.
The swine flu vaccine may do more harm than good. London's Daily Mail reported on August 15 that the UK's Health Protection Agency warned that the vaccine could trigger a brain disorder that "attacks the lining of the nerves, causing paralysis and inability to breath, and can be fatal." (Do you remember the 1976 flu outbreak – when more people died from the vaccine than from the flu?)
The White House is using the media, school children, and the swine flu to scare Americans into accepting socialized medicine.
It is complicit in allowing the swine flu into the United States and is working with a military contractor that stands to benefit greatly from an epidemic. Think the unthinkable. This is war. We must stand.

Also tell them to take their flu vaccine and stick it! And remind them that there is no Constitutional authority for the federal government to be involved in health care.
